Approval for a civil aviation event - Application

General information

Contests and displays involving civil aircraft are subject to approval pursuant to section 126 (1) Aviation Act (Luftfahrtgesetz, LFG).

Approval will be withheld if there are justified reasons to assume that the event might present a risk for public safety or public order, specifically in terms of traffic safety.

The completion of the procedure depends on the individual initial situation in each case. An incomplete submission of documents delays the procedure.

Authentication and signature

Authentication or signature of the application is not required.

Documents required

The application must include the following details:

  • Detailed identification of the event site (landing/take-off site), supported by a sketch/map, as appropriate
  • Time or period of time of the aviation event
  • Purpose of the aviation event
  • Programme of the aviation event
  • Description(s) and marking(s) of the aircraft involved
  • Names of pilots (including pilot licence numbers)
  • If the application is submitted by a legal entity: Extract from the company register (German) signed by the natural persons authorised to represent the entity
  • Where power of attorney was granted: Submission of power of attorney

Fees

The following costs are payable after completion of the administrative procedure:

  • EUR 65 in federal administrative charges
  • EUR 14,30 in charges pursuant to the Fees and Duties Act for submission of the application
  • Usually, from EUR 15,26 and EUR 45,78 in fees for official on-site presence of authority staff members, depending on the duration of the event

Form

Further information

The applicants must designate a suitable person to be present on site and in charge of ensuring compliance with safety rules during the aviation event. The name, address and phone number of such person must be made available to the authority during the course of the prior-approval investigation procedure, but in any case no later than three days prior to the event.

The civil aviation event will be permitted only if the person(s) authorised to make decisions with respect to the land in question has/have given their consent.

For the aviation event to proceed, it may also be necessary to obtain approval for flying below minimum altitude and for flying into the Vienna restricted area. Such approval can be obtained from Austro Control GmbH (German) or the associated Schwechat airport control centre, phone +43 1 05 17 03 0; email: info@austrocontrol.at

If the event exceeds the scope of a mere civil aircraft contest or display, it will usually be necessary to obtain approval for the event from Section V - Official Authorisation of Events)) (German) (MA 36-V), +43 1 4000 36310; email: post@ma36.wien.gv.at

Where drones (unmanned aircraft) are used, the competent public authority is Austro Control GmbH (German).

Means of redress or appeal

An appeal is possible against rulings issued by an authority and shall be filed by the party within a 4 weeks term with the authority that issued the ruling of first instance (against rulings without investigation procedure within a two weeks term). The term starts with the receipt of the written copy of the ruling, in the case of oral pronouncement simultaneously with it.

The appeal shall indicate the ruling it contests, the authority that issued the ruling and contain a motion of appeal with the reasons. No more appeal is admissible if the party expressly waived the right of appeal after receipt or pronouncement of the ruling.

Each ruling contains instructions on the right to appeal and indicates the authority and the deadline for submission of such appeal.
